Terms of Use for Eloquence Chess

1. Acceptance of Terms

By downloading or using Eloquence Chess, you agree to these Terms of Use and to any applicable App Store terms. If you do not agree, do not use the app.

2. Apple Standard EULA

Your use of Eloquence Chess is also subject to Apple's Standard End User License Agreement. If these Terms conflict with the Apple Standard EULA, the Apple Standard EULA applies to the extent required by Apple or applicable law.

3. App Description

Eloquence Chess is an offline-first chess playing, coaching, review and training app for iPhone and iPad. It may provide rated Classic games, unranked Academy games, local game analysis, training positions, history, statistics and optional Pro features.

4. Chess Ratings and Analysis

Displayed opponent ratings and the in-app Classic Rating are Eloquence values intended for orientation and progression. They are not official FIDE ratings, title assessments or guarantees of equivalent human playing strength.

Move classifications, performance scores, alternative lines and coaching are generated from local engine analysis and app rules. Chess analysis can be incomplete or mistaken and should be treated as educational guidance rather than an authoritative judgment.

5. Optional Purchases and Subscriptions

Eloquence Chess may offer optional auto-renewable subscriptions, a one-time purchase or other paid access to Pro features. The exact products, prices, billing periods, trial terms and included features available to you are shown in the App Store purchase flow before you confirm a purchase.

Subscriptions renew automatically until cancelled, subject to the terms displayed by Apple. Apple charges your Apple Account and manages billing, cancellation, refunds and subscription changes.

You can manage or cancel subscriptions in your Apple Account settings. Use Restore Purchases in the app to refresh eligible entitlements. A one-time purchase, when offered, applies to the Apple Account used for the purchase and is subject to Apple's restoration rules.

6. Changes to Features and Offers

Kaspar Media may improve, add, modify or remove app features, opponents, analysis methods, training formats and paid offers. We do not guarantee that every feature will remain available forever or function identically on every supported device.

Core offline functionality remains subject to technical compatibility, device resources, operating-system behavior and future app updates.

7. Acceptable Use

You may use Eloquence Chess for personal, lawful purposes. You may not:

• Misuse, disrupt or interfere with the app or its security
• Manipulate purchases, subscriptions or entitlement checks
• Reverse engineer, extract or redistribute protected app components except where applicable law expressly permits it
• Use the app or its output to violate applicable law or third-party rights
• Present Eloquence ratings or analysis as official FIDE certification

8. Intellectual Property and Open Source

Eloquence Chess, its branding, original interface, original chess-piece drawings, coaching system and related content are owned by Kaspar Media or its licensors.

The app includes the Arasan chess engine under the MIT License. Applicable open-source notices and license text are available inside the app. Open-source components remain governed by their respective licenses.

9. Local Data and Backups

Games, reviews, saved mistakes, ratings and settings may be stored locally on your device. You are responsible for maintaining appropriate device backups. Deleting the app, resetting statistics or losing access to a device may permanently remove local data.

10. Availability and Updates

Kaspar Media may release updates that change technical requirements or are necessary for compatibility, security and continued operation. The app may not be available without interruption or error on every device or operating-system version.

11. Disclaimer

Eloquence Chess is provided “as is” and “as available” to the maximum extent permitted by law. Kaspar Media does not warrant that the app, analysis or coaching will be error-free, uninterrupted or suitable for a particular competitive, educational or professional purpose.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Kaspar Media is not liable for indirect, incidental, special or consequential damages arising from use of or inability to use Eloquence Chess. Nothing in these Terms excludes liability that cannot lawfully be excluded.

13. Termination

You may stop using Eloquence Chess at any time. Kaspar Media may restrict access where reasonably necessary to protect the app, comply with law or address material misuse. App Store billing obligations remain governed by Apple until you cancel an active subscription.

14. Changes to These Terms

Kaspar Media may update these Terms when the app, paid offers or applicable requirements change. The current version will be published on this page with a new revision date.
