Terms of Service for PhotoGPT

1. Acceptance of Terms

By using PhotoGPT, users agree to these Terms.

2. App Description

PhotoGPT is an iOS app for image generation, image transformation and prompt-based photo editing. The app is designed for private creative workflows and local/on-device processing where supported.

3. User Responsibility

Users are responsible for their prompts, imported images, generated images, edits, exports and sharing behavior.

Users must ensure they have the necessary rights for images they import, transform, save or share.

4. Generated Content

Generated output may vary and may be imperfect, unexpected or unsuitable for a specific purpose.

Kaspar Media does not guarantee that generated images will always match a prompt, style or user expectation.

Users are responsible for reviewing generated content before use or publication.

5. Prohibited Use

Users may not use PhotoGPT to:

• Violate applicable law
• Infringe intellectual property rights
• Harass, defame or impersonate others
• Create misleading, harmful or abusive content
• Generate or distribute content that violates App Store rules
• Attempt to reverse engineer, disrupt or misuse the app

6. Local Processing and Device Performance

Generation time and output quality may depend on device model, available storage, memory, selected settings and image complexity.

Users should keep the app open and the device active while generation is running.

Kaspar Media does not guarantee uninterrupted generation on every device.

7. Purchases and Subscriptions

If PhotoGPT offers paid features, purchases or subscriptions, they are handled by Apple through the App Store.

Refunds, billing and subscription management are subject to Apple's App Store rules.

In version 2.0, Free includes 25 successfully saved AI images per local day and a required export watermark. Ordinary photo corrections do not consume this AI allowance. Premium removes the daily AI limit and makes the export watermark optional; it does not guarantee a particular generation speed or image quality.

Where Apple provides assigned access, the app uses verified entitlement status to recognize it. The person receiving assigned access does not thereby become the subscription purchaser. Billing-management options depend on the entitlement and Apple's available controls.

8. Intellectual Property

PhotoGPT, its design, branding, app structure, interface and related materials are owned by Kaspar Media or its licensors.

Users retain responsibility for their own imported content.

Generated output rights may depend on applicable law, user input, third-party rights and platform rules.

8a. Included Baseline Model

The included baseline model is a Core ML adaptation of Stable Diffusion v1.5. Its compiled model metadata identifies runwayml/stable-diffusion-v1-5. Copyright © 2022 Robin Rombach and Patrick Esser and contributors. The model is provided under the CreativeML Open RAIL-M license dated August 22, 2022 (full original text).

When using this baseline model or a derivative, you must comply with section 5 and all use restrictions in Attachment A of that license. Those restrictions are incorporated into these Terms for that model. If you redistribute the model or a derivative, you must also meet the license's distribution conditions, including passing on the license, required notices and use restrictions.

The distributed model resources are compiled for Core ML; the UNet and text encoder use 6-bit palettization. These are adaptations of the model, not an unmodified original checkpoint. The model's own license governs that model where it conflicts with other provisions on this page.

8b. Optional Models and Provider Terms

Additional models are optional and can require compatible hardware, available memory and storage, a provider account and acceptance of the model provider's own terms. They are not selected automatically. The core app does not require a Kaspar Media account.

A PhotoGPT Premium purchase is access to app features. It does not grant a separate license or sublicense to every optional model, remove a model's eligibility requirements, or guarantee that every device can run it. Users must obtain any required provider access and comply with the applicable model license and use restrictions.

The optional FLUX.3 model is bound in this release to its displayed provider revision and FLUX Kommunity License v.1.0. That license conditions model use and commercial-output eligibility. PhotoGPT does not certify that an individual user or use qualifies. The model provider controls access and may require an agreement from the user.

Local generation is distinct from online model downloads, provider webpages, Apple services and user-chosen exports. Provider-account handling is explained in the PhotoGPT privacy policy.

9. No Professional Advice

PhotoGPT is a creative tool. It does not provide legal, financial, medical or professional advice.

10. Disclaimer

PhotoGPT is provided "as is" and "as available".

Kaspar Media does not guarantee that the app will be error-free, uninterrupted or suitable for every creative purpose.

11. Limitation of Liability

To the maximum extent permitted by law, Kaspar Media is not liable for indirect, incidental, special or consequential damages arising from use of the app.

12. Changes to the App or Terms

Kaspar Media may update, modify or discontinue parts of PhotoGPT or these Terms. Changes will be published on this page.

13. Apple Standard EULA

Where applicable, use of PhotoGPT is also subject to Apple's Standard End User License Agreement:
